Art. 1 – Content of the contract – Description of the tour package

This contract consists of the General Conditions set out herein. The description of the tour package that is the subject of the contract is contained in the descriptions provided in the program agreed by email.
Art. 2 – Bookings

Acceptance of bookings by Travelers of Madagascar is subject to seat availability. The booking is considered confirmed upon receipt of the agreed prepayment.
Art. 3 – Specific agreements

At the time of booking, the traveller may make known specific requests and needs, which may be the subject of specific arrangements regarding travel arrangements, where technically possible. In such cases, the agreements will be included in the Special Conditions.
Art. 4 – Payments

At the time of booking, a deposit of €200 per person must be paid, plus Madagascar Airlines (formerly Tsaradia) domestic flights if included. The balance must be paid at least 30 days before arrival.

Art. 5 – Withdrawal / Cancellation

The traveller has the right to withdraw from the contract without paying any fee for cancellation up to 30 days before the scheduled arrival date in Madagascar, except for the deposit already paid.
Madagascar Airlines flights (formerly Tsaradia) – issued via our consolidator APG are non-refundable, regardless of the fare paid. We have been able to receive refunds lately, but it is not guaranteed. If a flight cancellation occurs and we are able to claim a refund, we will use that money towards the cost of getting you to the capital (Antananarivo). If we have arranged international flights, the conditions of the individual ticket apply. Travelers of Madagascar retains €100 per person in the case of international flight refunds.
Once the total tour payment (100%) has been made, the traveller may withdraw from the contract at any time before departure with the following penalties:
– from 30 to 23 days: the prepayment/deposit made at confirmation + €100 per person for administrative expenses + the actual costs incurred by Travelers of Madagascar (50% car hire, 50% guide and driver salary) and any payments required by the hotels booked according to their terms;
– from 22 to 10 days: 80% of the total participation fee;
– from 9 days: 100% of the total participation fee.

Art. 6 – Changes after departure

After departure, if an essential part of the services provided for in the contract cannot be performed, Travelers of Madagascar shall arrange suitable alternative solutions for the continuation of the planned trip without increasing the price of the agreed package, unless the client chooses to change the itinerary at their own discretion. In the latter case, Travelers of Madagascar will do its best to refund the unused part of the itinerary less any possible extra costs such as no-show fees at booked hotels or hired cars.
Art. 7 – Price

The price and booking of services that make up the tour are subject to change without notice, for reasons beyond Travelers of Madagascar's control, such as changes in costs (fuel) or exchange rates.
Art. 8 – Obligations of the traveller

The traveller must be in possession of a valid individual passport valid for at least 6 months after the date of departure, as well as any required residence visa.
Art. 9 – Organiser's liability

The organiser's liability to the traveller for any damage suffered as a result of failure to fulfil the obligations assumed under this contract is governed by the relevant laws and international conventions. Therefore, in no event shall the organiser's liability, however arising, exceed the limits provided for by the aforementioned laws and conventions in relation to the damage complained of. Furthermore, the organiser cannot be held liable for any damage arising from services provided by third parties not forming part of the tour package, or arising from autonomous initiatives taken by the traveller during the execution of the trip. The organiser assumes no liability for any damage that may be suffered by the traveller due to the impossibility of starting and/or continuing the trip, caused by the lack or irregularity of personal travel documents.
Art. 10 – Organiser's liability for Madagascar Airlines flights

The organiser is not responsible for any delays or cancellations of Madagascar Airlines (formerly Tsaradia) domestic flights. Tickets are issued via our consolidator APG. We have been able to obtain refunds in some cases, but it is not guaranteed. Should a cancellation occur and we successfully claim a refund, we will apply that amount towards the cost of alternative transport to bring you to Antananarivo.
Art. 11 – Complaint

Any failure in the performance of the contract noted on site by the traveller must be reported immediately so that the organiser, its local representative or the tour leader can remedy the situation promptly.
